Domestic Law- payment/ intercept of tax refunds

Now that all the holidays are over, you may be thinking of filing for divorce.  Many people use their tax refunds to pay for attorney fees.  I am able to take credit cards and I do work out payment plans.  Fees for cases that are settled might not be as expensive as you think.

If you or your spouse have any child support obligations your refund may be intercepted by the Family Support Center.  I suggest that you contact your accountant and discuss filing separate returns if the spouse without the obligation is not in agreement of using the refund to bring down the child support arrearage.  Many times if there is an intercept, the IRS sends notice to the taxpayer who does not have the support obligation and you can contest the intercept.

Bankruptcy

With tax season coming, it is important to file your returns and spend your tax refunds BEFORE you file bankruptcy if possible.  These funds should be spent on “reasonable and necessary living expenses”– pay your car insurance for the year, get dental work done, purchase your prescriptions in bulk, put new tires on your car or do any other needed maintenance, pay your attorney, etc.  If you have any questions on what would qualify, post a comment.  Your filing fee will be a maximum of $300 and you will need between $100-$125.00 for the credit counseling courses that are required.  Attorney fees can be anywhere between $750.00 – $3,000.00 depending on your case.    So spend wisely!
